Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Bula Rides application (the "Service") operated by Bula Rides ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Introduction

Bula Rides is a platform that connects passengers with independent taxi drivers in Fiji. We are not a transportation carrier and do not employ drivers. We act as a neutral intermediary to facilitate communication and transactions between passengers and drivers.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

3. Driver Registration and Conduct

Drivers wishing to use the platform must undergo a verification process. Drivers agree to maintain a valid driver's license, vehicle registration, and insurance. Drivers are independent contractors and are responsible for their own conduct, vehicle maintenance, and compliance with all local laws and regulations.

4. Passenger Conduct

Passengers agree to treat drivers with respect and to not engage in any unlawful, threatening, or harassing behavior. Passengers are responsible for any damage they cause to a driver's vehicle.

5. Fares and Payments

Bula Rides does not set fares, handle payments, or take any commission from rides. Fares are to be negotiated and paid directly between the passenger and the driver. We are not a party to any transaction and are not responsible for any disputes over fares or payments.

6. Credit System

The Service utilizes a "Credit" system for drivers. Credits are a virtual currency purchased by drivers to use the platform's features. Credits are non-refundable, have no cash value, and cannot be transferred between users. Credits are deducted from a driver's account for the following actions:

• Daily Online Fee: A fee for making their profile visible to passengers for the first time in a 24-hour period.
• Receiving Leads: A fee when a passenger initiates contact for an immediate, scheduled, or airport trip. The cost for each lead type is determined by us.
• Profile Boost: An optional fee to gain prioritized visibility in search results for a limited time.

We reserve the right to change the cost and function of credits at any time. A driver must have a sufficient credit balance to go online or receive leads.

7. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Bula Rides makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties. Because we are solely an intermediary platform, we are not responsible for the safety, quality, or legality of the transportation services provided by drivers or the conduct of any user. In no event shall Bula Rides be liable for any damages arising out of the use or inability to use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of Fiji, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
